Notice to all Muses

We are closing LM.

After many trials and errors, the mods believe this is in the best interest of everyone involved. As we were going through the list to see who was behind and who was current, 15 people were set to be removed. That would have been cutting over half the community.

We realize that the delays in posting new songs, and the continual changes in format may have turned some of you off to the community. We've tried to compensate for that with extensions, and overlooking some months. But ultimately, we feel that the community just isn't working. We apologize to those of you who were really involved and we appreciate all of the patience and understanding you have shown us.

The mods over at eclecticmuses have graciously offered membership to all of the muses who were current, and we have provided them with a list of who was in good standing, who was going to be cut, and who was on hiatus at the time. goaskmalice is one of the mods there, so expect good prompts.

You can check out their rules HERE for more information, including their e-mail address. Check out the TAKEN LIST to see if your muse is available, and then e-mail the mods and give them your muse's username and let them know that you were an active member before the closing. No application necessary.

If your muse is unavailable and you'd like to apply for a different one, or you'd fallen behind, check out their APPLICATION to apply.

Wanna pick songs for LM?

Hey lovelies. Happy Thanksgiving, all! Hope you all enjoyed it, and survived Black Friday for any of you who work retail or braved it for the great shopping deals. <3

Just wanted to let you guys know that we've decided that the last week of each month, is going to be like a Player's Choice kind of thing. Meaning, the three of us have a rotation and take turns picking the song each week so now, after the third mod does her choice, we will be using your suggested songs.

We feel that this will give everyone a chance to write challenges based on songs that really inspire you, or that you've always thought would make a great fic, etc.

You can suggest songs HERE and starting this Monday, you will start seeing your suggestions in our monthly rotation. :)

Please Read

A little news, my lovelies.

First of all, because I don't think that we have discussed this yet, or put it in the rules or made it abundantly clear, we have a ZERO TOLERANCE policy when it comes to drama. Now, look. Everyone's been involved in drama llama of some kind. Including me. I'm no saint. Hell, one time I wanked it up in my character journal. Ridiculous. But I'll certainly never do it again, and it was also an isolated incident.

If you have a problem with another player, you need to take it directly to them, or come to us. This backstabbing, talking trash in locked posts... do that at your own risk. Because a) whether or not you realize it, it gets back to people. Not even just the people you're talking about, but uninvolved parties. Especially when you drag into places like Bad RPers Suck or Fandom Wank. E-mails get forwarded back and forth, IMs get copied and pasted. It's a lot more trouble than I think any of you are really conciously asking for.

We can't regulate or censor what you write in your personal journals, and we're not even going to try. That's your business. Hell, some days Tara might piss me off, and I'll vent in a private entry about her. Whatever, it happens. But, if we catch you dragging LM business into Bad RPers Suck, Fandom Wank, or it gets back to us in another way, you're out. That is ridiculous, and I'm not going to tolerate having members who don't have enough respect for each other to take up their issues with the offending party and instead try and drum up a witch hunting party in other forums. Not cool. I'm not accusing anyone, I'm not kicking anyone out, because so far, everyone here gets along, and as far as I know of, no one's done anything like that to anyone here.

But, I was recently apprised of a situation where something like that did happen, and when I discussed it with the other two mods, we all agreed on a stance and felt the need to make it clear.

I'm not saying you can't go post wherever you want to. I'm just saying that we're not going to have drama here, and if there is a situation, it's going to be resolved, not dragged all over LJ and communication services. Capiche?

One strike, and you're out. Seriously. We're not playing. You're an adult, we expect you to handle things like one.


Second thing, we're not sure if everyone knows the parameters of the community, like what you're allowed to write and such. The thing is, there are no parameters. Like, most of us have figured out what we want to do with our characters here, what season, what place, etc. we want to set them.

So there's what we consider LM canon, which is what you'll use and refer to like say, if you want to RP or if you want to have an established background for your prompts.

But, let's say you want to write something else. Let's say you want to write a ship that isn't what your character is LM canon wise. Or let's say you want to write a cross fandom fic. Or something completely and totally AU. That's completely fine.

Examples, Gin and I have already written several versions of Jack and Kate from Lost, and we don't even know what we want to do canon wise here. But for the same challenge, we both did AU post rescue fics that were completely different, and then for the next challenge, she even did a continuation of my fic.

So, whatever you want to write, whatever pairing, whatever rating, whatever fandom(s), it's all fair game. You can write strictly LM canon, you can do all various fics, you can do both.

But from now on, we will be using a header, so that people won't get confused. And so that no one will get mad if you do something with their character they don't like or disagree with, it will all be disclaimed in your header. So like, if you kill someone's character or write an NC-17 fic or whatever, no one will confuse it with the canon.

So at the beginning of all fics/prompts from now on, please include:

Author's Note:

In your rating, please include WHY it's rated that way, so that we don't have to have a seperate field for warnings. So like "R for violence" "R for character death" NC17 pretty much speaks for itself. But if you have NC17 plus some violence or a death or whatever, be reasonable and say so. Just in case someone out there might not want to read that, or might not want to read that happen to the particular characters you're writing about.

Your Author's Note is the place where you can throw up any disclaimers you'd like, or mention where you got the inspiration for the fic. Maybe you based it on a particular person's version of a character that you play with, or a certain game or one on one and you want to give them a shout out or link a thread or the game in general that inspired it. Just some little note to say this is not based on LM itself, but some idea you had.

Normally, we'll give people warnings and let you get caught up if you're no more than one behind, but we already gave a warning a week ago, so if you didn't heed it then...

Song Suggestion!

We've decided that the last week of each month, is going to be like a Player's Choice kind of thing. Meaning, the three of us have a rotation and take turns picking the song each week so now, after the third mod does her choice, we will be using your suggested songs.

We feel that this will give everyone a chance to write challenges based on songs that really inspire you, or that you've always thought would make a great fic, etc. If you have a song that you'd really like to be the weekly prompt, let us know! Comment here with the song's title, artist, a link to the lyrics, and an upload. We will use your song in one of our upcoming rotations, depending on how many suggestions we have so far, and no worries on having to re-upload or anything, as we will do this for you.

Song suggestions are not mandatory, but just in case you get sick of writing about the songs that we pick, we want everyone to have the occasional option to write about a song that they pick, and here is that option!

Comments are screened in case you have anything else to say, any questions, comments, or otherwise suggestions we'll be glad to hear.

Legal Disclaimer

There have been some concerns over the uploading and sharing of mp3s as part of this community's challenge procedure. Taking a page from various other communities that deal with copyright infringement, I'm just going to go ahead and post a pre-emptive disclaimer regarding the Fair Use doctrine of copyright law.

We, the moderators of this community, feel that our usage of mp3s in this community does in fact fall under the category of fair use, an affirmative defense that is protected by the rights underlined in the First Ammendment.

We feel that our usage is applicable to the following criteria, in these specific ways:

1. Purpose and character

The first factor questions whether the use under consideration helps fulfill the intention of copyright law to stimulate creativity for the enrichment of the general public, or whether it aims to only "supersede the objects" of the original for reasons of, say, personal profit. In order to justify the use as fair, one must demonstrate how it either advances knowledge or the progress of the arts through the addition of something new.

Our community is to use songs as inspiration for purposes of writing fiction. We believe this "stimulates creativity for the general public" in a very literal way. No one in this community is making any profit whatsoever, nor is this being done for any type of commercial gain. Should any of our writers become published authors, it will not be with the material formed here, without specific permission from the copyright holders. We feel that writing, based on inspiration drawn from music, is indeed a progress of the arts.

2. Amount and substantiality

The third factor assesses the quantity or percentage of the original copyrighted work that has been imported into the new work. In general, the less that is used in relation to the whole, e.g., a few sentences of a text for a book review, the more likely that the sample will be considered fair use.

We feel that our usage also meets this particular criteria, on the grounds that we are posting only one song per artist. We are not now, nor will we ever upload entire albums, which truly would defeat or inhibit an artist's sales. We feel that posting a single song will not hurt record sales, but possibly help by exposing our members to music they may not have even heard before, though the intention of this community is not to promote new music. We feel that it is an incidental benefit instead. We consider this especially true considering some of the music we use and will continue to use is over ten years old.

3. Effect upon work's value

The fourth factor measures the effect that the allegedly infringing use has had on the copyright owner's ability to exploit his original work. The court not only investigates whether the defendant's specific use of the work has significantly harmed the copyright owner's market, but also whether such uses in general, if widespread, would harm the potential market of the original. The burden of proof here rests on the defendant for commercial uses, but on the copyright owner for noncommercial uses.

Again, we feel that our usage has no effect on an artist's ability to exploit or promote their music. We feel that we do no harm, simply by posting the work in its original form for interpretation, nor do we feel that such usage could or would harm the artist's market. We stress once more that this is for noncommercial use. If anything, we feel that we may help improve the artist's market by exposing more consumers to their music. It is not intended to be a "direct market substitute" for the original work, nor do we feel that any harm "might exist beyond that of direct substitution, such as in the potential existence of a licensing market." We are not creating new CDs with these mp3s, we aren't selling them. We are simply sharing them for purposes of writing exercises.

No infringement is intended, all artists are clearly credited for their work, and all characters in this community who are not the intellectual property of their writer have clear disclaimers. All writers here believe that their usage constitutes fair use. The moderators take no responsibility for any person who does not disclaim their usage of copywritten entities.
